If you have a pistol braced firearm that's barrel is < 16 ", as of 1/31/2023 the regulation was published in the Federal Register reclassifying that weapon as a Short Barreled Rifle (SBR).
If you wish it to retain its old Pistol classification you must remove the brace and ensure that you have a PISTOL tube attached so that the brace cannot be reattached to the firearm. If you instead choose to accept the reclassification you have 2 options available to you
1) File the NFA Form 1 with the ATF to officially register this SBR. You have until May 31st 2023 to register this under their amnesty period without paying for the tax stamp.
2) Destroy or Surrender the firearm to the ATF
It is our hope at The Cary Brass Guy LLC that our customers never get to the "Destroy / Surrender" option.
Please note - you MAY NOT transfer that firearm with a pistol brace on it unless it has a fully completed and approved form 1 to register it, and then it would transfer under a form 4. That is at least an 18 month process, so if you wish to sell it to someone, REMOVE THE BRACE, PUT PISTOL BUFFERS ON IT!
What you ultimately do is a personal choice, but should you choose to register this as an SBR The Cary Brass Guy LLC is here to help you with your fingerprinting needs and engraving needs.
When filing your eForm 1 or eForm 4 paperwork, you are required to submit fingerprints and photographs of the owner or all responsible parties on the Trust. While the ATF will still accept paper copies of these items, it will increase the processing time significantly.
The Cary Brass Guy LLC will take your photos, capture your fingerprints and provide you the files necessary to be submitted with your form 1. Unfortunately due to ATF regulations, The Cary Brass Guy LLC cannot file a form 1 on your behalf. These files are yours to keep and use with any future form 1 or form 4 submissions you make.
